The following Terms and Conditions specify the general terms of sale applicable in our online store available at the following addresses: https://harmonyposters.com, https://harmonyposters.eu, https://harmonyposters.pl, operated by Marcin Zbijowski Consulting, NIP: PL9372367351, REGON: 121086976. The business activity is registered in the Central Register and Information on Economic Activity (CEIDG), managed by the Minister responsible for the economy.

1. Scope of the Terms and Conditions

These Terms and Conditions apply to all orders placed by Consumers and Entrepreneurs through our online store.

A Consumer, according to Article 22 of the Civil Code, is a natural person who is conducting a legal transaction with a business entity not directly related to their business or professional activity.

An Entrepreneur, according to Article 43 of the Civil Code, is a natural person, legal person, or organizational unit without legal personality, to whom the law grants legal capacity, conducting business or professional activity on their own behalf.

Other or supplementary Terms and Conditions and General Trade Conditions applied by Entrepreneurs are not applicable - they will become part of the contract only when we explicitly and in writing agree to it.

2. Conclusion of the Agreement

The sales agreement is concluded with Marcin Zbijowski Consulting.

The presentation of products on our online store is an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code. To place an offer for purchasing products, you need to place an order. By using the mechanisms available on our store, you can add selected products to the shopping cart and place an offer to purchase. The shopping cart and the information entered in the forms can be modified before placing an order using the available functionalities and messages displayed during the order placement process.

By clicking on the confirmation button on the order summary page, you are placing an order for the products in your cart. After placing the order, you will receive an email from us confirming receipt of the order and its acceptance for processing. The sales agreement is concluded upon receipt of this message.

3. Language and Recording of the Agreement

The sales agreement can be concluded in Polish or English.

We keep the content of the agreement and send you data related to your order and our Terms and Conditions via email. You can also check information regarding your orders through your customer account. The Terms and Conditions are also available on our website in a way that allows you to access, reproduce, and store its content.

4. Delivery of Products

In some cases, additional delivery costs may apply to the prices of the products. The ordered products are delivered through cooperating courier companies. Detailed information about available delivery methods and timeframes, as well as shipping costs, are presented during the order placement process and in a special information tab on our store's website.

In general, it is possible to pick up the products in person at the address: Marcin Zbijowski Consulting,Dębina Zakrzowska 115, 32-830 Dębina Zakrzowska, between 10:00 and 17:00.

5. Payments

The entity providing online payment services for card payments is Blue Media S.A.

The following payment methods are available in our online store:

  • Fast online transfers
  • Debit/credit card payments: Maestro, Visa, Visa Electron, Mastercard, Mastercard Electronic

Detailed information about available payment methods, including integrated online payment services and available types of e-payments, as well as any additional costs, is presented during the order placement process and on our store's website in a special information tab about payment methods.

The order processing time is calculated from the moment of a positive payment authorization. In the case of payment by bank transfer or credit card, it is counted from the date of crediting the Seller's bank account.

6. Right to Withdraw from the Agreement

According to the information provided in the withdrawal from the agreement notice, you have the statutory right to withdraw from the agreement. You have the right to withdraw from this agreement within 14 days without giving any reason. More details and a withdrawal form template can be found here.

The Seller will refund the payment using the same payment method used by the consumer, unless the consumer has explicitly agreed to a different method of refund that does not incur any costs.

7. Damages during Transportation

For Consumers: In the case of a consumer distance purchase, our store always bears the risk of accidental damage or loss of goods during transportation. If the ordered products are delivered with obvious transport damage, please promptly report such defects to the delivery company and contact us. Delay in making such a complaint or contact has no consequences for your statutory claims and their satisfaction, in particular your rights based on statutory warranty for defects described below. However, prompt reporting will help us assert our claims against the carrier or transport insurer.

8. Warranty, Guarantees, and Seller's Liability

For Consumers: We are obliged to deliver products free from defects. The statutory liability for defects of the sold item (warranty for defects) applies within the scope specified in Article 556 and subsequent of the Civil Code. We are liable under the warranty if a physical defect is found before two years from the date of delivery of the item to you. In the case of used movable property being the subject of the sale, the liability under the warranty is limited to one year from the date of delivery.

We will process complaints within 14 days of their receipt.

In case of exercising rights under warranty – if we deem it necessary to examine the complaint, you are obligated to deliver the faulty item to the postal address indicated above at our expense. If, due to the nature of the item or the way it is installed, delivering it would be excessively difficult, you are obliged to make the item available to us at the location where it is situated.

Information regarding any additional warranty and its specific terms is always included with the product and available on the informational pages of the online store.

Applies to Entrepreneurs (excluding natural persons entering into an agreement directly related to their business activity, when the content of this agreement indicates that it does not have a professional character for these persons within the meaning of Article 556 (4) of the Civil Code - so-called "entrepreneur-consumers"): warranty rights are lost if you do not examine the goods at the time and in the manner commonly adopted for items of this type and you do not immediately notify us of the defect, and in the case where the defect is revealed at a later time - if you do not notify us immediately after discovering it. In the absence of notification of the defect, the goods are considered accepted. Complaints can be submitted electronically and in writing to the address indicated above. We are liable solely for typical foreseeable damages at the time of concluding the agreement and their normal consequences, and we do not assume liability for lost profits. In relation to entrepreneurs (excluding so-called "entrepreneur-consumers"), our liability, regardless of its legal basis, is limited - both for individual claims and for all claims combined - to the amount of the price paid and the delivery costs related to the sales agreement concluded with us.

9. Electronic Services

To use our online store, including browsing the assortment and placing orders, you need to have a multimedia device with an installed internet browser and access to the Internet and email. In the browser settings, it is recommended to enable the JavaScript and Cookies options. Users are obliged to use the online store in a manner consistent with the law and good practices, and it is prohibited to provide unlawful content.

We take all necessary actions to ensure the full functionality of our store's website and interface, to the extent resulting from the current technical knowledge, and we undertake to remove any reported irregularities and technical problems in a reasonable time. The above also applies to the possibility of signing up for the newsletter or optionally creating a customer account - if these services are provided within our store. If you notice any irregularities or disruptions in the functioning of our online store, please notify us through the contact details provided above. For complaints regarding irregularities related to the technical functioning of the online store, please indicate the type and date of the irregularity.

10. Out-of-Court Dispute Resolution

We would like to inform consumers that they have the option to use an out-of-court method for handling complaints and pursuing claims. Information on accessing the aforementioned procedure and dispute resolution procedures can be found at the following address: www.uokik.gov.pl under the "Out-of-Court Consumer Dispute Resolution" tab.

Furthermore, at the address: http://ec.europa.eu/consumers/odr, consumers have access to the online platform for resolving consumer disputes (known as the ODR platform). The ODR platform is a multilingual, interactive website designed to assist consumers and traders in resolving disputes arising from online sales contracts or service contracts out of court.

Utilizing the above-mentioned out-of-court methods for pursuing claims and resolving disputes is voluntary and can only take place when both parties to the dispute (consumer and seller) agree to it.

11. Final provisions.

None of the provisions of this Regulation is intended to violate the statutory rights of the Consumer. In the event of any inconsistency between the provisions of this Regulation and the Consumer's rights arising from generally applicable laws, the statutory regulations shall always prevail over the disputed provisions of the Regulation.

If you are an Entrepreneur, then Polish law, excluding the United Nations Convention on Contracts for the International Sale of Goods, applies to all agreements concluded with us.

If you are an Entrepreneur, a legal person under public law, or a separate public entity, the court exclusively competent to settle all disputes arising from contractual relationships between us and you shall be the court having jurisdiction over our registered office. The foregoing sentence does not apply to natural persons who enter into an agreement directly related to their business activity if the content of this agreement indicates that it does not have a professional character for these individuals within the meaning of Article 556 (4) of the Civil Code.
